Hmmm...Could you tell me what I have done wrong? Sorry. Yup, saved up a few years. All cash...not a credit fan. Already an owner at GFV, but we have wanted to add for a while:

I think you would need to add in the closing costs and any dues paid by you at closing to the $$15,200 number. That would make it apples to apples with everybody else.
 
So is there a new thread we go to obsess at once we get waived through rofr... I am still waiting but have already passed rofr....

The format is on page one of this thread- the total should include all closing costs, annual dues paid at closing, any extra fees (some brokers charge an extra $195, for example), and if you are financing, the financing costs are included in the total closing costs as well.

$79 SSR $9480--120 pts- 120/15,120/16,120/17 February UY, I pay closing 700(includes closing cost and admin fee)and 2016 dues seller pays 2015 dues and estoppel. Sent 4/15 .....ugh the stress is killing me! Hopefully I'll hear before my bday 5/10☺️ Paying cash

Disney has 30 days for ROFR. If it goes past 30 days does it automatically pass?
Sending positive vibes. The wait is agonizing.

Today is 30 days... can they go past that? Are they maybe checking estoppel (I'm probably just dreaming on that one hahaha)? This has been a crazy ride.
Maybe thats a little info on how ROFR works though, multiple departments all get a crack at approving it/ taking it before it is sent back.

Another week?? Oh my goodness. I could be wrong on this, but they have up to 30 days before your closing date to make a decision on ROFR. Someone correct me if I'm wrong...

Well, since you asked, and now that those suffering the most have now received good news... I shall answer that for you. :teacher:

Are they allowed to take that long? YES. The statement "they have 30 days" is not accurate. It took 32 days for them to waive ROFR on my first contract. I, personally, didn't mind too much, but I thougth my better half was going to have to be hospitalized. :scared:

The policy states that you have to give them at least 30 days before the closing date to make a decision. It does NOT specifically say that they only have 30 days. Now, if you set the closing date to exactly 30 days out from when they are notified, you could THEN close if they don't respond in time. However, it's completely unrealistic that you'd somehow manage to date the contract properly and then instantly close right at the 30 day mark just before they're able to snatch it up. Nevertheless, they do tend to respond with a waiver or notice within 30 days (or at least close to it.)

Note the statement in bold below:


"... Owners or Cotenants desiring to sell their Unit or Ownership Interest must notify DVD in writing no less than thirty (30) days in advance of the proposed closing date of their intent to sell and must include a copy of the proposed transaction reduced to writing in all respects. On receipt of such written notice, DVD may determine prior to the proposed closing date whether to exercise its right of first refusal set forth in this Article 13. If DVD elects to exercise its right of first refusal, DVD must notify the Owner or Cotenant in writing of such election, and the purchase by DVD must be closed on or before the proposed closing date. If DVD fails to notify the Owner or Cotenant of its election to exercise its right of first refusal prior to the proposed closing date, then the Owner or Cotenant may proceed to close on the transaction with such bona fide third party."

So, what is the average wait for ROFR? Do they typically stretch it out the entire 30 days?

I think the average is 26 days, I passed in 21 days(which seems to be unusual these days). We did have some on here recently that did go the entire 30 days. There doesn't seem to be any rhyme or reason for length of ROFR time.

I think it really depends on what day of the week you submitted and when your 30 day mark falls. If you are lucky, they will decide a week early if your 30 day mark falls on a weekend. My last contract, I submitted 6/8/13 (Saturday) and they decided 7/1/13 (Monday), which is 24 days. My 30 day mark fell on a Sunday, so they decided a week early. Just my 2 cents.

There is an estoppel thread and a closing thread l am following. They are not nearly as active as this one though. They're a little quieter over there. Lol!:mic:
 
I waited to decide about buying into DVC until after our trip which so happened to be over the dreadful April 4th... I come back and wanted to go through with it only to find out about the changes. After being disappointed for a few weeks, I decided it still made sense even if I am a "second-class" member. Wish me luck:
